General terms & conditions

Please carefully review the following Terms and Conditions as they constitute the legally binding agreement between you, hereinafter referred to as the Guest, and the Agency, as defined below:

The Agency: ELEMENT PROJEKT d.o.o., represented by Ema Škabar, who will provide the Guest with available options of the Vessel or the Accommodation based on their preferences and requirements.
The Guest: is the individual (natural or legal person) renting the Accommodation or the Vessel, as well as any person or member of the group on whose behalf the Accommodation or the Vessel is rented for specific period.
The Accommodation: any type of villa or hotel.
The Vessel: any type of boat, motor yacht, sailboat, catamaran, gulet or mini cruiser.
The Owner: the owner of the Accommodation or the Vessel. Property manager or Central Agency who represents the Owner.
Period: The duration in which the Accommodation or the Vessel is under the possession and/or control of the Guest, as specified and in compliance with these Terms and Conditions.

Price and rates:

Prices depend on the type of the Accommodation or the Vessel, date of stay, length of stay, number of guests, payment and cancellation conditions and any additional services.
On each received individual offer, depending on whether it is for the Accommodation or for the Vessel, it is stated what is included in the price and what is not.
The sent offer refers only to the rental of the Accommodation or the Vessel, all other costs are additionally paid in advance or on the spot depending on individual possibilities.
The rental prices may be expressed with or without VAT.
The Agency reserves the right to change prices on the web.
Tourist tax is not included in the price. Tourist tax is EUR 1.40 per person per day. Children up to 12 years of age are exempted from paying the tourist tax, while children from 12 to 18 years of age pay 50% of the tourist tax fee. Fees are subject to change in accordance with the laws and other applicable regulations.

Booking procedure:

Reservations can be made via email, our website, online booking, telephone, or in person.
To confirm your reservation, a 50% deposit payment is required.
All types of special services that are not included in the price are paid by the Guest and he is obliged to order them when making a reservation or on request on the spot.

Deposit and payment:

A non-refundable deposit of 50% of the total booking amount is required to secure the booking. The deposit must be paid within 7 working days of booking confirmation.
The remaining 50% of the total booking amount is required to be paid 40 days prior to the guest’s arrival at the property.
Payments must be made in Euros (€) via bank transfer to the Agency account.

Check-in and check out:

Check-in time to the Accommodation or to the Vessel on the day of arrival is usually from 5 p.m., and check-out is usually till 9 a.m. on the day of departure.
Guests are required to provide valid identification and any necessary travel documents upon check-in. Individuals under 18 must be able to show written permission to travel with an accompanying adult from the parent(s) or guardian.

Cancellation policy:

In case of the cancellation by the Guest, the deposit will not be refunded.
Please note that we operate under a No Refund Policy.
The free cancellation of the reservation is possible only if it is defined in the sent offer and in writing, by e-mail.

Responsibilities and regulations:

The Guest agrees to abide by all rules and regulations set forth by the Owner. The Guest will be held responsible for any damages caused to the Accommodation or the Vessel or its contents during their stay, beyond normal wear and tear.
The Agency acts solely as an intermediary between the Guest and the Owner and shall not be held liable for any disputes, damages, or losses incurred during the Guest’s stay. The Guest is advised to obtain travel insurance to cover any unforeseen circumstances or events that may affect their booking or stay.

Complaints:

The Guest is obliged to submit to the Agency a written complaint if occur no later than 5 days after check-out from the Accommodation or from the Vessel. Only those complaints will be considered.

Jurisdiction:

Any disputes arising between the Owner, the Guest, and third parties shall be exclusively settled by the competent Court in Split. The resolution process will adhere to this Terms and Conditions and the applicable laws of the Republic of Croatia.
